Terms and Conditions

Jackman People Solutions Pty Limited ("Jackmn", "we", "us", or "our")

IMPORTANT: These Terms and Conditions contain extensive exclusions and limitations of liability. By accessing our website, products, or services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing, browsing, using, purchasing, or relying on any website, software, platform, product, service, content, material, deliverable, or advice provided by Jackmn (collectively, the "Services"), you agree to be legally bound by these Terms and Conditions, our Privacy Policy (set out in Part B below), and any additional terms notified to you.

If you do not agree, you must immediately cease using the Services.

2. No Advice Disclaimer

All Services are provided for general information and business purposes only. Nothing provided by Jackmn constitutes legal, financial, employment, industrial relations, tax, medical, or other professional advice.

You must obtain your own independent professional advice before relying on any Service. You use and rely on the Services entirely at your own risk.

3. Consulting and Technology Services

Jackmn provides consulting services (including technology and human resources consulting) and develops software and technology solutions.

All deliverables, recommendations, tools, software, and outputs are provided "as is" and "as available" without any warranties, guarantees, or representations of any kind, whether express or implied.

4. Third Parties

Jackmn may engage third-party contractors, developers, designers, consultants, service providers, or platforms to assist in delivering the Services.

Jackmn is not responsible for, and disclaims all liability arising from, any acts, omissions, errors, failures, delays, breaches, defects, or misconduct of any third party, whether engaged directly by Jackmn or indirectly through the Services.

5. No Warranties

To the maximum extent permitted by law, Jackmn disclaims all warranties, representations, or conditions, express or implied, including (without limitation) warranties of merchantability, fitness for purpose, accuracy, non-infringement, availability, security, or performance.

Jackmn does not warrant that:

  • the Services will be uninterrupted, secure, error-free, or timely
  • defects will be corrected
  • the Services will meet your requirements
  • data will not be lost, corrupted, compromised, or accessed without authorisation

6. Limitation of Liability

To the maximum extent permitted by law:

(a) Jackmn is not liable for any loss, damage, cost, expense, or liability whatsoever arising out of or in connection with your use of, reliance on, or inability to use the Services.

(b) This includes, without limitation, direct, indirect, incidental, consequential, special, exemplary, or punitive damages, loss of profits, revenue, data, business opportunity, goodwill, or reputation.

(c) Jackmn's total aggregate liability, if not excluded by law, is limited to the amount paid by you to Jackmn for the specific Service giving rise to the claim or AUD $100 (whichever is lower).

7. Indemnity

You indemnify and hold harmless Jackmn, its directors, officers, employees, contractors, and agents from and against any claim, loss, damage, liability, cost, or expense arising from:

  • your use of the Services
  • your breach of these Terms
  • your reliance on any output or deliverable
  • any third-party claim relating to your activities or data

8. Website Use

You use the website at your own risk. Jackmn does not guarantee the accuracy, completeness, or suitability of any website content.

We are not liable for viruses, malware, system failures, outages, or data loss arising from website use.

9. Intellectual Property

All intellectual property rights in the Services remain the property of Jackmn or its licensors. No rights are transferred except as expressly agreed in writing.

10. Termination

Jackmn may suspend or terminate access to the Services at any time without notice or liability.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales.

Part B - Privacy Policy

This Privacy Policy forms part of these Terms and Conditions.

1. Privacy Commitment

Jackmn is committed to protecting personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and where applicable, the GDPR.

2. Collection and Use

We may collect personal information when you use our Services, contact us, or engage with our business. Information is used solely to provide and improve Services, communicate with you, comply with legal obligations, and protect our legitimate interests.

3. Third Parties and Overseas Transfers

Personal information may be processed or stored by third-party providers located in Australia or overseas (including infrastructure, hosting, analytics, and form-processing providers).

We take reasonable steps to ensure appropriate safeguards are in place but do not guarantee the security or jurisdictional treatment of data.

4. No Absolute Security

While we implement reasonable security measures, you acknowledge that no system is completely secure and accept the risk of data transmission and storage.

5. Access and Complaints

Requests or complaints relating to privacy may be submitted via the contact form on jackmn.com.au.

6. Updates

This Privacy Policy may be amended at any time and takes effect upon publication.
